Trans-Allegheny Interstate Line - Construction Code of Conduct For Employees of TrAILCo and its Contractors and Subcontractors

This Construction Code of Conduct applies to all field activities and any interaction with property owners and occupants of property and members of the general public by employees of Trans-Allegheny Interstate Line Company (TrAILCo) and its contractors and subcontractors in the course of constructing the Trans-Allegheny Interstate Line (TrAIL). All employees of TrAIL and its contractors and subcontractors are required to comply with the following Code during the construction of TrAIL:

  1. Maintain, without deviation, an attitude of sincerity, tolerance, consideration, and assistance toward others, regardless of position.
  2. Respect the dignity, rights, safety and personal property of others.
  3. Exercise patience and remain positive under all circumstances.
  4. Show consideration for the safety and welfare of everyone, including the natural environment.
  5. Practice the principles of being good stewards of the land. Only use designated access points when entering property.
  6. Always close gates/fences when entering or exiting property. Assume all farms are in active use. Be aware of your surroundings. Avoid causing damage to property off of right-of-way. Always adhere to designated access roads when entering or leaving construction area.
  7. Always follow Biosecurity Measures developed by the West Virginia Department of Agriculture for any farm visit with Livestock or Poultry.
  8. All incidents involving land owner (i.e. – damage to fields, fences, or other property, or a land owner request for information) issues on or off the Right of Way must be reported on the Land Owner Contact Form. This form must be completed and emailed, faxed or hand delivered to your appropriate Kenny Construction Coordinator. All issues must be verbally reported to your Kenny Construction Coordinator. You must speak to someone in person. Do not leave messages. This is not acceptable.
  9. In the event that any agency or media representative visits your construction area you must contact your appropriate Kenny Construction Coordinator who will follow the appropriate protocol.
  10. In the event your vehicle tracks mud onto road-ways, take immediate steps to have the debris safely removed so that it poses no risk to public safety.
  11. Be aware, during dry months your vehicle may produce dust while driving on dirt and gravel roads. Be sure to keep your vehicle at an appropriate speed, especially around residential areas, in order to suppress dust.
  12. Any contact or interaction with property owners requires you to promptly identify yourself as representing TrAILCo and display your TrAILCo photo ID badge.
  13. Any communication initiated by a property owner, whether in person, by telephone or in writing, in which the property owner indicates he or she does not want to allow work activities on his or her property, must be respected and politely accepted without argument. Unless specifically authorized by Kenny Construction, do not contact the property owner again regarding work activity.
  14. In the event you are asked to leave a property by a land owner during construction, promptly leave and do not return unless specifically authorized by Kenny Construction. Procedures to follow when ordered from a land owner’s property are:

    • Make sure the construction site is secure before leaving.
    • Relocate your crew to a safe and secure area.
    • Once you have reached a safe area, contact your supervisor immediately. Your supervisor must contact your Kenny Construction Coordinator immediately.
  15. If you or your crew encounter any opposition as a result of any construction activities (i.e. - angry land owners or any organized groups demonstrating within your work area), always follow these procedures:

    • Always ensure your and your crew’s safety as well as the safety of those who are not authorized to be on the construction site.
    • Stop all construction activities and secure the construction site in order to ensure the safety of any un-authorized person or group.
    • If necessary, you and your crew re-locate in a non-threatening manner to a safe and secure area.
    • Immediately report all work stoppages to your Kenny Construction Coordinator. You must speak to someone in person. Do not leave messages. This is not acceptable.
  16. If you find that your access to any construction site is blocked by any un-authorized person or group, always re-locate to a safe and secure area in a non-threatening manner. Immediately report all incidents to your supervisor who will immediately contact a Kenny Construction Coordinator.
